1041.01 PURPOSE.

The purpose of this chapter is to establish procedures for the use and maintenance of existing and new holding tanks designed to receive and retain sewage, whether from residential or commercial uses. It is hereby declared that the enactment of this chapter is necessary for the protection, benefit and preservation of the health, safety and welfare of the inhabitants of the Township.  (Ord. 712. 1041.02 DEFINITIONS.

As used in this chapter, unless the context specifically and clearly indicates otherwise:

(a)   “Authority” means the Southwest Delaware County Municipal Authority, Delaware County, Pennsylvania.

(b)   “Department” means the Pennsylvania Department of Environmental Resources.

(c)   “Holding tank” means a watertight receptacle, whether permanent or temporary, which receives and retains sewage conveyed by a water-carrying system and which is designed and constructed to facilitate the ultimate disposal of the sewage at another site.

(d)   “Improved property” means any property within the Township upon which there is erected a structure intended for continuous or periodic habitation, occupancy or use by human beings, and from which structure sewage shall or may be discharged.

(e)   “Officer” means the Deputy Health Officer employed by the Township.

(f)   “Owner” means any person or corporation vested with the ownership, legal or equitable, sole or partial, of any property located in the Township.

(g)   “Person” means an individual, an association, a public or private corporation (for profit or not-for-profit), a partnership, a firm, a trust, an estate, a department, board, bureau or agency of the United States, the Commonwealth, a political subdivision, a municipality, or a district, the Authority or another legal entity which is recognized by law as the subject of rights and duties. The term “person” includes the members of an association, partnership or firm and the officers of a local agency or municipal, public or private corporation for profit or not-for-profit.

(h)   “SEO” means the State Certified Sewage Enforcement Officer employed by the Township.

(i)   “Sewage” means a substance that contains the waste products, excrement or other discharge from the bodies of human beings or animals and noxious or deleterious substances that are harmful or inimical to the public health, to animal or aquatic life or to the use of water for domestic water supply or for recreation, or which constitutes pollution under the Clean Streams Law.

(j)   ‘Township” means Aston Township, Delaware County, Pennsylvania.

1041.03     POWERS OF SOUTHWEST DELAWARE COUNTY MUNICIPAL AUTHORITY.

The Authority is hereby authorized and empowered to undertake within the Township the control of the operation and maintenance of holding tanks, holding tank sewage disposal and the collection and transportation thereof.  (Ord. 712. Passed 10-20-93.)
