EDITOR’S NOTE: Ordinance 694, passed March 18, 1992, authorized an agreement between the Township and the Southwest Delaware County Municipal Authority, whereby the Authority will covenant and agree to own and operate certain sanitary sewage facilities required for rendering sewage service in and for portions of the Township and certain adjacent municipalities, and the Township will make certain covenants and agreements with respect to the sewer system and any additions thereto to be acquired, constructed, owned and operated by the Authority. Copies of Ordinance 694 and of such agreement may be obtained, at cost, from the Township Secretary. 

This chapter, previously a codification of Ordinance 693, passed March 18, 1992, was re-enacted in its entirety by Ordinance 775, passed July 15, 1998.

1045.01 SHORT TITLE.

This chapter shall be known and may be cited as the “Township of Aston Wastewater Treatment Ordinance,” and the said Township shall be referred to hereinafter as the “Municipality.”

1045.02 INTENT.

This chapter is adopted to promote and protect the public health, safety, comfort, convenience and other aspects of the general welfare. These general goals include the specific enforcement of the various regulations promulgated by the Southwest Delaware County Municipal Authority (SWDCMA), the United States Environmental Protection Agency (USEPA), the Pennsylvania Department of Environmental Protection (PA DEP), and such other agencies which may succeed the aforementioned agencies. 1045.03 PURPOSES.

This chapter sets forth uniform requirements for users of the wastewater collection and publicly owned treatment works (POTW) for this Municipality to comply with all applicable State and Federal laws including the Clean Water Act (33 U.S.C. 1251 et seq.), and the General Pretreatment Regulations (40 CFR Part 403). The objectives of this chapter are to:

(a)    Prevent the introduction of pollutants into the POTW that will interfere with the operation of the POTW;

(b)    Prevent the introduction of pollutants into the POTW which will pass through the POTW, inadequately treated, into receiving waters or otherwise be incompatible with the POTW;

(c)    Ensure that the quality of the wastewater treatment plant sludge is maintained at a level which allows its use and disposal in compliance with applicable statutes and regulations;

(d)    Protect POTW personnel who may be affected by wastewater and sludge in the course of their employment and to protect the general public;

(e)    Improve the opportunity to recycle and reclaim wastewater and sludge from the POTW;

(f)     Provide for fees for the equitable distribution of the cost of operation, maintenance and improvement of the POTW; and

(g)    Enable the POTW to comply with its NPDES permit conditions, sludge use and disposal requirements, and any other Federal or State laws to which the POTW is subject.

1045.04 APPLICATION OF CHAPTER; SCOPE.

This chapter shall apply to all industrial users of the POTW. This chapter authorizes the issuance of wastewater discharge permits; authorizes monitoring, compliance and enforcement activities; establishes administrative review procedures; requires industrial user reporting; and provides for the setting of fees for the equitable distribution costs resulting from the program established herein.  (Ord. 775. 1045.05  ADMINISTRATION AND ENFORCEMENT,

The administration and enforcement of this chapter shall be by an officer or person appointed by the governing body. Any powers granted to or duties imposed upon such officer or person may be delegated to other personnel.  (Ord. 775. Passed 7-15-98.)

1045.06 VIOLATIONS.

It is intended that this chapter provide for the enforcement and prosecution of the Standards, Rules and Regulations adopted by SWDCMA, USEPA and PA DEP. The Municipality hereby ordains and establishes that any person, firm or corporation who or which fails or refuses to comply with the Standards, Rules, and Regulations of the Southwest Delaware County Municipal Authority, which are set forth in this chapter shall be subject to the penalties set forth in this chapter.  (Ord. 775.
