1045.08 ABBREVIATIONS.

           1045.09 GENERAL SEWER USE REQUIREMENTS.

(a)     Prohibited Discharge Standards. No industrial user shall introduce or cause to be introduced into the POTW any pollutant or wastewater which causes pass through or interference. These general prohibitions apply to all industrial users of the POTW whether or not they are subject to categorical pretreatment standards or any other National, State or local pretreatment standards or requirement, except hauled waste as permitted under Section 1045.10(e). Furthermore, no industrial user may contribute the following substances to the POTW:

(1)    Pollutants which create a fire or explosive hazard in the municipal wastewater collection and POTW, including, but not limited to, waste streams with a closed-cup flashpoint of less than 140 degrees Fahrenheit (sixty degrees Centigrade) using the test methods specified in 40 CFR 261.21.

(2)    Any wastewater having a pH of less than 5.0 or more than 9.0, or otherwise causing corrosive structural damage to the POTW or equipment, or endangering personnel.

(3)    Solid or viscous substances in amounts which will cause obstruction of the flow in the POTW resulting in interference, but in no case solids greater than three inches or seven and one-half centimeters in any dimension.

(4)    Any wastewater containing pollutants, including oxygen demanding pollutants (BOD or TSS, etc.) released in a discharge at a flow rate and/or pollutant concentration which, either singly or by interaction with other pollutants, will cause interference with either the POTW or any wastewater treatment or sludge process, or which will constitute a hazard to humans or animals. The POTW reserves the right to affix surcharges for excess BOD or TSS discharge concentrations,

(5)    Any wastewater having a temperature greater than ninety degrees Fahrenheit (32.2 degrees Centigrade), or which will inhibit biological activity in the treatment plant resulting in interference, but in no case wastewater which causes the temperature at the introduction into the treatment plant to exceed 104 degrees Fahrenheit (forty degrees Centigrade).

(6)    Petroleum oil, non-biodegradable cutting oil, or products of mineral oil origin, in amounts that will cause interference or pass through and/or otherwise result in total fats, oils and greases in excess of 100 mg/I.

(7)    Any pollutants which result in the presence of toxic gases, vapors or fumes within the POTW in a quantity that may cause acute worker health and safety problems.

(8)    Any non-permitted trucked or hauled waste. Permitted waste shall be discharged at points designated by the POTW in accordance with Section 1045.10.

(9)    Any noxious or malodorous liquids, gases, solids, or other wastewater which, either singly or by interaction with other wastes, are sufficient to create a public nuisance, or a hazard to life, or to prevent entry into the sewers for maintenance and repair.

(10)     Any wastewater which imparts color which cannot be removed by the treatment process, such as, but not limited to, dye waste and vegetable tanning solutions, which consequently imparts color to the treatment plant’s effluent, thereby violating this POTW’s NPDES permit. Color (in combination with turbidity) shall not cause the treatment plant effluent to reduce the depth of the compensation point for photosynthetic activity by more than ten percent from the seasonably established norm for aquatic life.

(11)     Any wastewater containing any radioactive wastes or isotopes except as specifically approved by the Enforcing Officer or as delineated in the Wastewater Discharge Permit, in compliance with applicable State or Federal regulations.

(12)     Storm water, surface water, ground water, artesian well water, roof run-off, subsurface drainage, swimming pool drainage, condensate, de-ionized water, non-contact cooling water, and unpolluted industrial wastewater, unless specifically authorized by the Enforcing Officer.

(13)     Any sludges, screenings, or other residues from the pretreatment of industrial wastes.

(14)     Any medical wastes, except as specifically authorized by the Enforcing Officer in a wastewater discharge permit.

(15)     Any wastewater causing the treatment plant’s effluent to fail a toxicity test.

(16)     Any wastes containing detergents, surface active agents, or other substances which may cause excessive foaming in the POTW.

(17)     Any discharge of fats, oils, or greases of animal or vegetable origin over 100 mg/l.

Wastes prohibited by this section shall not be processed or stored in such a manner that they could be discharged to the POTW. All floor drains located in process or materials storage areas must discharge to the industrial user’s pretreatment facility before connecting with the POTW.

(b)     Federal Categorical Pretreatment Standards. The national categorical pretreatment standards found at 40 CFR Chapter 1, Subchapter N, Parts 405-471 are hereby incorporated herein by reference.

(c)     State Requirements. In the event that State pretreatment standards are approved by the EPA, the same shall be incorporated herein.

(d)     Specific Pollutant Limitations. Effective immediately, all non-residential users shall be subject to effluent testing parameters, methods and limits. Failure to comply with these requirements will be considered a violation of the POTW’s Rules and Regulations and, in accordance with the provisions of local, State and Federal law, shall be subject to the penalty provided in Section 1045.99(a).

The pollutant limits are established to protect against pass through and interference. No person shall discharge wastewater containing in excess of the limits delineated in the significant industrial user discharge permit. A copy of the pollutant limits established and approved by the POTW and the EPA are available on request from the POTW.

Concentrations apply at the point where the industrial waste is discharged to the POTW. All concentrations for metallic substances are for “total’ metal unless indicated otherwise. At his or her discretion, the Enforcing Officer may impose mass limitations in addition to or in place of the concentration based limitations established herein.

(e)     Dilution. No industrial user shall ever increase the use of process water, or in any way attempt to dilute a discharge, as a partial or complete substitute for adequate treatment to achieve compliance with a discharge limitation, unless expressly authorized by an applicable pretreatment standard or requirement. The Enforcing Officer may impose mass limitations on industrial users which are using dilution to meet applicable pretreatment standards or requirements, or in other cases when the imposition of mass limitations is appropriate.
