1060.05 FEES; DELINQUENCY; REMEDIES.
(a) The fee for the collection and disposal of ashes, rubbish and garbage placed for collection at ground level and not more than ten feet distant from the side of the street, highway or alley, from which collection is made, shall be as provided from time to time by resolution of the Board of Commissioners. (Adopting Ordinance)
(b) An account shall be due and payable by the owner of the real estate as provided for the payment of real estate taxes, and If the same is not paid within sixty days from the time of the delivery of the bill, the account shall be considered delinquent and the service of collection of ashes, rubbish and garbage shall be stopped without further notice.
(c) It shall be the duty of the Township Treasurer to forthwith notify the Township Secretary as to which bills for the collection of ashes, rubbish and garbage have not been paid, and the Township Secretary may certify to the person in charge of directing the collections that service on such delinquent accounts shall cease. Service shall be resumed thereafter only on payment of the annual collection charges, unless the Board of Township Commissioners specifically directs otherwise. The stoppage of service hereinbefore authorized for nonpayment of collection charges shall be in addition to the right of the Township to proceed for the collection of such unpaid charges by an action In assumpsit or, at the election of the Township, in any other manner provided by law. 1060.06 EXEMPTION FROM PAYMENT.
The Board of Township Commissioners may exempt any person from the payment of fees provided for in this chapter after an application made to the Board and a hearing thereon. Such exemption and exoneration from payment may be made only after compliance with the Township regulations relating thereto and after the applicant has submitted a request for exoneration on the forms required by the Township Secretary. Such exoneration shall be only for the year granted and may be revoked at any time by the Board. The Township shall be under no obligation to collect the garbage, ashes, rubbish or other refuse of the persons to whom an exoneration from payment of the fees hereunder has been granted. (Ord. 336. 1060.07 FEE DUE DATES; DISCOUNT; INTEREST AND SURCHARGES.
The fee for the collection and disposal of garbage, ashes, rubbish, refuse and other matter as provided for in Section 1060. 05 shall be due and payable by the owner on or about July 1 of each and every year.
(a) If the aforesaid fee is paid between July 1 and September 1 of each year, the person paying such fee shall be allowed a two percent discount on such fee.
(b) If the aforesaid fee is paid between September 1 and November 1 of each year, then such fee shall be payable on the face amount. U such fee is not paid by November 1 of the year when due, then such face amount shall bear interest and penalties the same as real estate taxes and at the same Interest rate. (Ord. 336. 1060.08 DETERMINATION OF FEES; RULES AND REGULATIONS.The Board of Township Commissioners may, by ordinance or resolution, determine the fees to be paid for the collection services provided for under the provisions of this chapter and establish, modify, amend and/or revoke rules and regulations pertaining thereto. 1060.09 RECYCLING PROGRAM. (REPEALED)
(EDITOR’S NOTE: Section 1060.09 was repealed by implication by Ordinance 667, passed September 19, 1990. See Chapter 1064.)
1060.10 USE OF TOWNSHIP YARD AND TOWNSHIP BULK TRASH CONTAINER.
(a) Residents of the Township who desire to bring their bulk items to the Township yard shall pay a minimum fee of five dollars ($5.00) per item, or a fee of fifteen dollars ($15.00) per half ton pick-up average load.
(b) The use of the Township bulk trash container shall be limited to residents of the Township.
(c) Only residential trash shall be brought to the Township bulk trash container. No commercial trash or contractors are permitted the use of such container. (Ord. 88-06. Passed 1-20-88.)
1060.11 REMOVAL OF DUMPSTERS UPON TERMINATION OF BUSINESS USE.
When any business ceases to operate, is discontinued or is abandoned for a period of ten days or longer, all trash dumpsters and trash or refuse receptacles shall be removed from the premises upon the expiration of the aforesaid ten day period. (Ord. 650. Passed 4-19-89.)

Whoever violates Section 1060.11 shall be fined not more than six hundred dollars ($600.00), plus all court costs, including reasonable attorney’s fees, incurred by the Township as a result thereof. A separate offense shall be deemed committed each day during or on which a violation occurs or continues, unless the District .Justice determining that there has been a violation further determines that there was a good faith basis for the person violating Section 1060.11 to have believed that there was no such violation.
