1064.06 SEPARATION AND DISPOSAL OF LEAF WASTE.

It shall be unlawful to dispose of leaf waste from any property in the Township with residential, commercial or institutional waste. Only residential leaf waste will be collected by the Township. (Ord. 667. Passed 9-19-90.)

1064.07 COLLECTION BY UNREGISTERED PERSONS.

Recyclables shall become the property of the Township or its authorized agent from the time of placement of recyclables at the curb. It shall be a violation of this chapter for any person not registered by the Township to collect or pick-up such recyclables or cause them to be picked up or collected at any such time. Any and each such collection in violation thereof from one or more locations shall constitute a separate and distinct offense punishable as provided in Section 1064.99.

1064.08 ENFORCEMENT; RULES AND REGULATIONS.

(a)     The Municipality is authorized and directed to enforce this chapter. The same is hereby authorized and directed to establish and promulgate recycling regulations as to the manner, days and times for the collection of recyclable materials in accordance with the terms hereof and as to any other matters required to implement this chapter. The Municipality may change, modify, repeal or amend any portion of said rules and regulations at any time.

(b)     Sections 1064.03 and 1064.04 shall not be enforced until three months from the effective date of regulations authorized to be promulgated hereunder.  (Ord. 667. Passed 9-19-90.)

(c)     Pursuant to subsection (a) hereof, the following regulations have been established by the Board of commissioners:

(1)    All residents serviced by Township trash collection must recycle clear and colored glass, plastic bottles (#1 and 2), aluminum and bi-metal cans and newspaper. Plastic bottles, aluminum, glass and cans must be rinsed, lids removed and placed in the blue container on the curbside prior to 7:00 am. on the day of the resident’s regular trash collection. Recyclables will be collected hi-weekly by the Township’s designated contractor.

         Leaves must also be separated from the trash stream by the residents, These leaves will be collected by the Township on designated dates. Leaves must be raked or placed in bags or containers at the curbline on the designated dates. Leaves will not be collected if they are mixed with grass and clippings, branches, twigs, animal excrement or other foreign materials,

(2)    The Township will distribute to each resident serviced by Township collection service a blue twenty-gallon container for collection of materials, Lost or additional containers can be purchased from the Township at a cost of nine dollars ($9.00). These are limited to the present supply. Similar containers clearly marked “Recycling” may be used. These containers can be used for no other purpose than those described above.

(3)    Residential living groups or units utilizing private trash pick-up (not collected by the Township) shall be responsible to contract with that collector to recycle those items mentioned above. The method of recycling those materials shall be arranged with the private hauler.                           

        These residential dwellings are also responsible to contract with a private contractor for the collection and removal of leaves.

(4)     Commercial, institutional and Municipal establishments shall be responsible to arrange with a private contractor to separate, collect and recycle high grade office paper, plastic bottles (#1 and 2), aluminum, clear and colored glass, corrugated paper, newsprint and leaf waste.

(5)     All contractors collecting and disposing of refuse and recyclable materials from private residential properties or commercial, institutional or Municipal establishments, must register with the Township on a yearly basis and pay an annual license fee of fifty dollars ($50.00), The contractor must provide the Township with a list of the properties being collected and a written quarterly report setting forth the quantities of materials being removed from each property. In addition, the contractor must submit proof of liability insurance and proof of workers’ compensation coverage as provided for in the Pennsylvania Workmen’s Compensation Act, as amended July 2, 1993. 1064.09 RECYCLING OF MATERIALS.

No person shall dispose of recyclables with ordinary Municipal waste. Recyclables shall be taken to a recycling facility. It shall be a violation of this chapter to dispose of recyclables in landfills or incinerators except with the written permission of the Township. (Ord. 667. Passed 9-19-90.)

1064.10 AGREEMENTS WITH COLLECTION AGENCIES.

The Municipality will enter into agreements with public or private agencies or firms to authorize them to collect all or part of the recyclable materials from curbsides.  (Ord. 667. Passed 9-19-90.)

1064.11 ALTERNATIVE COLLECTION OF RECYCLABLE MATERIALS.

Any person may donate or sell recyclable materials to individuals or organizations authorized by the Municipality in its recycling regulations. These materials must either be delivered to the individual’s or organization’s site or they may be placed at curbside for collection by said individual or organization on days not indicated as recyclable material collection days by the Municipality. Said individuals or organizations may not collect recyclable materials on or immediately preceding (within twenty-four hours) a regularly scheduled curbside collection day.  (Ord. 667. 1064.99 PENALTY.

(a)     Whoever violates or fails to comply with any of the provisions of this chapter, or with any rule or regulation adopted pursuant to this chapter, for which no penalty is otherwise provided, shall be fined not more than twenty-five dollars ($25.00) upon a first conviction, fifty dollars ($50.00) upon a second conviction and one hundred dollars ($100.00) upon a third or subsequent conviction.

(b)     Whoever violates Section 1064.06 shall be fined not more than three hundred dollars ($300.00).
