1250.01 TITLE

This Title Six of Part Twelve of these Codified Ordinances shall be known and may be cited as the ‘Township of Aston Zoning Ordinance of 1989” and shall be referred to hereinafter as “this Zoning Code.” (Ord. 662. Passed 2-21-90.)

 

 

 

1250.02 PURPOSE.

The zoning regulations and districts set forth in this Zoning Code are designed to achieve the following purposes as stated in the Pennsylvania Municipalities Planning Code, Act 247 of 1968, as amended by Act 170 of 1988:

 

(a)    To promote, protect and facilitate any or all of the following: the public health, safety, morals, and the general welfare; coordinated and practical community development and proper density of population; emergency management preparedness and operations, and national defense facilities, the provision of adequate light and air, access to incident solar energy, police protection, vehicle parking and loading space, transportation, water, sewerage, recreational facilities, public rounds, the provision of a safe, reliable and adequate water supply for domestic, commercial, agricultural or industrial use, and other public requirements; as well as preservation of the natural, scenic and historic values in the environment and preservation of forests, wetlands, aquifers and floodplains.

 

(b)    To prevent one or more of the following: overcrowding of land, blight, danger and congestion in travel and transportation, loss of health, life or property from fire, flood, panic or other dangers.

 

(c)    To provide for the use of land within the Municipality for residential housing of various dwelling types encompassing all basic forms of housing, including single-family and two-family dwellings, and a reasonable range of multi-family dwellings in various arrangements, mobile homes and mobile home parks.

(d)    To accommodate reasonable overall community growth, including population and employment growth, and opportunities for development of a variety of residential dwelling types and nonresidential uses.

1250.03 COMMUNITY DEVELOPMENT OBJECTIVES.

The zoning regulations and districts Bet forth in this Zoning Code are based on the goals and objectives which are stated in the Aston Township Comprehensive Plan of 1987. This Zoning Code is intended to implement the principles, policies, and objectives of the Comprehensive Plan and to guide and regulate the orderly growth and development of Aston Township.

1250.04 ESTABLISHMENT OF CONTROLS.

(a)    Minimum and Uniform Regulations. Unless specifically indicated otherwise, the regulations set forth in this Zoning Code shall be minimum regulations and shall apply uniformly to each class or kind of structures or land.

 

(b    Proposed Uses and Structures. In all zoning districts, after the effective date of this Zoning Code, any new building or other structure or any tract of land shall be constructed, developed, and used only in accordance with the regulations specified herein, except where a variance has been authorized by the Zoning Hearing Board in accordance with Chapter 1254.

 

(c)    Existing Uses and Structures. In all districts, after the effective date of this Zoning Code, any lawful, existing building or other structure or any tract of land which is not in conformity with the regulations of the district in which it is located shall be deemed to be nonconforming and subject to the regulations of Chapter 1294. 1250.05 INTERPRETATION.

In the interpretation and application of the provisions of this Zoning Code, the said provisions shall be held to be the minimum requirements for the promotion and protection of the public health, welfare, and safety. Where the provisions of this Zoning Code impose greater restrictions than those of any other ordinance or regulation, the provisions of this Zoning Code shall be controlling. Where the provisions of any statute, other ordinance or regulation impose greater restrictions than this Zoning Code, the provisions of such statute, ordinance, or regulation shall be controlling.  (Ord. 662. 1250.06 SEPARABILITY.

If any article, section, subsection, paragraph, clause, or provision of this Zoning Code shall be declared invalid by a court of competent jurisdiction, such decision shall not affect the validity of this Zoning Code as a whole or of any other part.  (Ord. 662. Passed 2-21-90.)
