410.01   DEFINITIONS; REFERENCES TO VEHICLE CODE.

Unless otherwise specified, the terms used in this Traffic Code shall have the mean­ings ascribed to them In the Vehicle Code of the Commonwealth of Pennsylvania, being the Act of June 17, 1976 (P. L. 162, No. 81), codified as Title ‘75 (Vehicles) of the Pennsylvania Consolidated Statutes, the 1976 edition, as amended.

References in this Traffic Code to the “Vehicle Code of Pennsylvania” or just the “Vehicle Code” shall be deemed to mean the Code previously described in this section.

 

410.02   AUTHORITY OF POLICE DEPARTMENT AND FIRE COMPANIES; EMERGENCIES;       COMPLIANCE WITH LAWFUL ORDERS.

(a)  It shall be the duty of the Police Department to enforce the provisions of this Traffic Code.

(b)  Officers of the Police Department are hereby authorized to direct all traffic, either in person or by means of visible or audible signals, in compliance with the provisions of this Traffic Code, provided that in the event of a fire or other emergency or to expedite traffic or to safeguard pedestrians, officers of either the Police Department or the Fire Companies may direct traffic as conditions may require, notwithstanding the provisions of this Traffic Code.

(c)  No person shall refuse to comply with any lawful order or direction of a police officer or fireman.

410.03   SPEED TIMING DEVICES.

In carrying out its traffic control functions in the Township, the Police Department is hereby authorized to use any and all electrical and/or mechanical speed timing devices which are now, or shall hereafter be, approved by the Pennsylvania Department of Transportation or any other Commonwealth agency with appropriate jurisdiction. Such speed timing devices shall include, but are not limited to, the Vacar Plus and the Excessive Speed Preventor (ESP), Model TK100.

410.04   ALL TERRAIN VEHICLES

            SECTION 1:            DEFINITION 

            All terrain vehicles shall include motorized four (4) wheel, three (3) wheel or two (2) wheel recreational vehicles and motorcycles, with the exception of handicapped vehicles.    

            SECTION 2:  PROHIBITED USE OF ALL TERRAIN VEHICLES:

            The use of any all terrain vehicle is prohibited on any Township property, including the Aston Community Center, catwalks and other walkways, all parks and open space within the Township, on any school property within Aston Township and on all Township roadways.  Only human-powered vehicles such as bicycles are permitted in the above-mentioned areas.  

            SECTION 3:  LEGISLATIVE INTENT: 

            It is the intent that this Ordinance shall be supplemental to any laws of the Commonwealth of Pennsylvania hereinabove or hereafter adopted covering the use of all terrain vehicles and motorcycles within the Commonwealth of Pennsylvania and specifically in Aston Township.  

            SECTION 4:  VIOLATIONS and PENALTIES: 

            In cases involving the violation of this Ordinance, it shall be the duty of the Police Officers of Aston Township to deliver to the individual in violation of this Ordinance a written notice within forty-eight (48) hours of the violation, either by personally serving the same upon the individual in violation or by mailing same to his/her last known address by registered mail, which notice shall specify a description of the vehicle in question, its license plate number if applicable, the nature of the violation, the date and approximate time of the violation and the location of the violation.  Each such individual in receipt of any such violation notice shall pay at the Aston Township Municipal Building as a penalty for and in full consideration of such violation up to the sum of $600.00.  Any individual who violates this Ordinance or fails to pay the aforesaid penalty shall, upon conviction in a summary proceeding before the District Justice, be subject to a fine of not less than $25.00 nor more than $600.00, for each violation hereof, to be collected by the District Justice as like fines and penalties are now, by existing law, collected. 

Upon the second violation under this Ordinance involving the same individual and all terrain vehicle, after one citation has been previously issued, the Aston Township Police Department will confiscate said all terrain vehicle.

 

            SECTION 5:  SEPARABILITY: 

            Should any section or provision of this Ordinance be declared by a  Court of competent jurisdiction to be invalid, such decision shall not affect the validity of the Ordinance as a whole, or any part, hereof. 

            SECTION 6:  REPEALER 

            All ordinances or parts of ordinances inconsistent with this Ordinance are hereby repealed.

 

            SECTION 7:  EFFECTIVE DATE  

            This Ordinance shall take effect and be enforced from and after its enactment as required by law.

        410.11         SPEED LIMITS.              

(a)         Lenni Road.  The speed limit on Lenni Road from the intersection with Birney Highway to the Chester Creek Bridge on Lenni Road, at the Middletown Township and Aston Township border, is hereby established as thirty-five miles per hour.  (Ord. 457.  Passed 8-17-77.)

(b)         Mount Road.  The speed limit on Mount Road between Pennell Road and Birney Highway is hereby established as thirty-five miles per hour for all vehicles except those limited to a lower maximum speed by the Vehicle Code of Pennsylvania.  (Ord. 170.  Passed 8-15-56; Ord. 710.  Passed 7-21-93.)

(c)            Miscellaneous Streets.  A maximum speed limit of twenty-five miles per hour is hereby established for all vehicles, except those limited to a lower maximum speed by the Vehicle Code of Pennsylvania, on Crestview Lane, Clearview Lane, Overlook Drive, Belle View Road, Hillside Road, Summit Circle, Moser Street, Highwoods Drive and Arbor Lane within the Township.  No person shall drive a vehicle in excess of such speed limit on such roads within the Township.

(d)         Red Hill Road.  The speed limit along Red Hill Road, from the intersection with Concord Road to the intersection with Mount Road, is hereby established as twenty-five miles per hour.

(e)            Concord Hills Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in Concord Hills Development:  Victoria Drive, Kings Cross Road, Gladstone Way and Eusden Drive.

(f)          Aston Village Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in Aston Village Development:  Aston Court and Thomas Road.

(g)         Chester Plaza Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in Chester Plaza Development:  Roberts Road, Pierce Road, Ronald Road, Wellington Road, Patterson Road, Pancoast Avenue, Crystle Road, Miriam Avenue and Rosemont Avenue.

(h)         New Green Ridge Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in New Green Ridge Development:  Norman Street, Scarlet Avenue, Herald Place, Hurford Place, Florence Avenue, Mercer Place and Pancoast Avenue.

(i)            Hunter’s Knoll Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in Hunter’s Knoll Development:  Crestview Lane, Gettysburg Drive and Cisco Lane.

(j)                 School Zone on Pancoast Avenue.

(1)               There is hereby established a fifteen mile per hour school zone on Pancoast Avenue between Dutton Mill Road and Wellington Road between the hours of 7:00 a.m. and 8:00 a.m. and 2:00 p.m. and 3:30 p.m., Monday through Friday.

(2)               Signs indicating the speed limit in such school zone and the specified periods of time shall be erected. 

(k)               Ballinahinch Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in the Ballinahinch Development:  Franciscan Way, Glendale Boulevard, Grace Lane, Kildare Lane, West Dublin Way, East Dublin Way and County Claire Lane.

(l)                  Woodbrook Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in the Woodbrook Development:  Anvil Road, Blackthorne Lane, Cobblestone Road, Williams Drive and Woodbrook Way.

(m)              Highpoint Farms Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in the Highpoint Farms Development:  Highpoint Lane, Hillcrest Lane and Country Lane.

(n)                Springhill Farms Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in the Springhill Farms Development:  Kelly Drive and Springhill Drive.

(o)               Dawnwood Village Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in the Dawnwood Village Development:  Ashbrooke Lane, Caroline Drive, Edwards Drive, Erb Drive, Hillcrest Lane, Roberta Drive and Sickles Drive.

(p)               Rolling Hills Industrial Park Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in the Rolling Hills Industrial Park Development:  Crozerville Road, from Birney Highway to Bodley Road, Mount Pleasant Drive and Kent Road.

(q)               New Bridgewater Development.  There is hereby established a speed limit of twenty-five miles per hour on the following roads in the New Bridgewater Development:  Judy Way, Beatrice Lane, Mercedes Drive, Marie Circle, Romaine Way, Megan Circle, Kristine Way and Dorothy Circle.

(r)                 Signs.  Signs indicating the speed limits provided in this section shall be installed, and when they are installed no person shall operate a motor vehicle at a speed exceeding such limits.

410.99   GENERAL TRAFFIC CODE PENALTY; WAIVER.

(a)  Whoever violates or fails to comply with any of the provisions of this Traffic Code, including any rule or regulation promulgated pursuant thereto, for which no penalty is otherwise provided, shall be fined Fifty dollars ($50. 00) and costs of prosecution.

(b)  Upon a plea and proof that a person is unable to pay any fine and costs imposed under subsection (a) hereof, a court may, in accordance with the Pennsylvania Rules of Criminal Procedure, order payment of the fine and costs in installments and shall fix the amounts, times and manner of payment.

(c)   Any person charged with a violation of any provision of this Traffic Code for which payment of a prescribed fine may be made, may pay such sum in the manner prescribed on the issued traffic ticket. Such payment shall be deemed a plea of guilty, waiver of court appearance and acknowledgment of conviction of the alleged offense and may be accepted in full satisfaction of the prescribed penalty for such alleged violation. Payment of the prescribed fine need not be accepted when laws prescribe that a certain number of such offenses shall require court appearance.
