Commercial and Heavy Vehicles
440.01 General weight restrictions.

440.01 GENERAL WEIGHT RESTRICTIONS.
No motor carrier registered as a truck, a combination unit or a trailer shall be operated on any street of the Township if it has a registered gross weight in excess of 11,000 pounds, if it has a Class 4 or higher registration, as defined by the Vehicle Code of Pennsylvania, 75 Pa.C.S. 1980, et seq., or if it is a foreign motor carrier which would be classified as Class 4 or higher if it were to be registered in the Commonwealth pursuant to the Vehicle Code, without a special permit issued by the Chief of Police. For the purposes of this chapter, gross weight of 11,000 pounds shall not be exceeded by any truck towing a trailer, when the combined weight of truck and trailer exceeds 11,000 pounds, or by any combination unit having a combined weight of truck and trailer in excess of 11,000 pounds. 440.02 SPECIAL WEIGHT RESTRICTION ON SCARLET AVENUE.
Under authority of Section 4902
of the Vehicle Code, no motor vehicle, trailer or semi trailer that has a
chassis weight of more than 2,000 pounds or a maximum gross weight in excess of
5,000 pounds shall be operated on Scarlet Avenue between Bridgewater Road and
Dutton’s Mill Road. (Ord. 729. Passed 8-17-94.)
440.03 VEHICLES EXCLUDED FROM WEIGHT RESTRICTIONS.
This chapter shall not apply to all Municipal vehicles, emergency vehicles, motor homes owned by Township residents, school buses or those motor carriers making local deliveries. (Ord. 751. Passed 9-18-96.)
440.04 STREETS EXCLUDED FROM WEIGHT RESTRICTIONS.
The following streets are excluded from the restrictions set forth in this chapter:

Avon Road
Birney Road
Bodley Road
Bridgewater Road
Cherry Tree Road
Concord Road
Convent Road from Mount Road to Chester Creek
Crozerville Road from Birney Highway to Bodley Road
Dutton’s Mill Road

Legion Road
Lenni Road
Liewelyn Road
Marianville Road from Pennell Road to Shubrook Road
Mount Pleasant Road
Mount Road
New Road from Mount Road to Crozerville Road

Tryens Road from Concord Road, 900 feet to an unnamed private drive

These streets are State highways and are therefore not subject to weight restrictions set by the Township.

440.05 PERMIT REQUIRED FOR OPERATION ON RESTRICTED STREETS.
(a) Upon application and for good cause, the Police Chief may issue a local permit authorizing an applicant to move an oversize or overweight vehicle or combination of vehicles upon local streets and highways. The Police Chief may grant a permit for a single or round trip, or for such period of time, not to exceed one year, as the Police Chief, in his or her discretion, deems advisable, or for the duration of any construction project. The Police Chief may limit or prescribe terms or conditions of operation for such vehicles or combination of vehicles by designating the route, hours, speed or such other restrictions as may be necessary for the preservation of the public peace, property, health and safety. The Police Chief may require the posting of bond or other security necessary to compensate for any damage to a roadway or road structure. For each such permit, the Police Chief shall charge ten dollars ($10.00), and for each hour of time or any part thereof spent by the Police Department in supervising the movement of such vehicle, the applicant shall pay fifty dollars ($50.00).

(b) Except as provided in Section 440.04, streets and highways shall be posted with signs indicating “no thru trucks - gross weight 5 tons” or words of similar import to apprise drivers of the limitations imposed by this section. No driver shall disobey the instructions indicated on any such sign.
(c) Violation of any of the limitations, terms or conditions of the permit granted by the Police Chief shall be cause for immediate revocation or suspension of such permit and denial of request for any future permit.

440.06 DETERMINATION OF GROSS VEHICLE WEIGHT.
For purposes of this chapter, gross vehicle weight shall be that weight which is stamped on the manufacturer s serial plate attached to any vehicle. If there is no manufacturer’s serial plate attached to a vehicle, then the lowest weight indicated in any vehicle class of registration, as defined in 75 Pa.C,S. 1980, P.L. 12, No. 8, et seq., shall determine the weight of any such vehicle cited for a violation of any of the provisions of this chapter. Signs shall be placed in conformance with Section 4902.e of the Vehicle Code. (Ord. 729. Passed 8-17-94.)
Whoever violates any of the provisions of this chapter shall be fined not less than seventy-five dollars ($75.00) nor more than three hundred dollars ($300.00) for each 500 pounds or part thereof in excess of the weight limits specified in this chapter. (Ord. 729. Passed 8-17-94.)
