454.04    DESIGNATION OF APPROVED STORAGE GARAGES; BONDING; TOWING  AND  STORAGE.

The removal and impounding of vehicles under this chapter may be effected by any police officer or may be effected only by an approved storage garage that shall be designated, from time to time, by the Board of Township Commissioners. The owner or operator of each such garage shall submit evidence to the Board that it is bonded or has acquired liability in­surance, in an amount satisfactory to the Board, as sufficient to indemnify owners of im­pounded vehicles against loss or damage to those vehicles while they are in the custody of the garage keeper for the purpose of towing or storage. The owner or operator of the approved storage garage shall submit to the Board his or her schedule of charges for the towing and storage of vehicles under this chapter, and when the schedule is approved by the Board those charges shall be made by the approved storage garage. No other charges shall be demanded of or collected from any person whose vehicle Is removed or impounded under this chapter by an approved storage garage. The Board shall delete from Its list of approved storage garages any garage that makes any unapproved charge in connection with any vehicle removed or impounded under this chapter. (Ord. 586. 454.05    PAYMENT OF TOWING AND STORAGE CHARGES.

‘The payment of any towing and storage charges authorized by this chapter shall, unless payment is made under protest, be final and conclusive, and shall constitute a waiver of any right to recover the money so paid. If payment of any towing and storage charges is made under protest, the offender shall be entitled to a hearing before a district justice. Payment of towing and storage charges shall not relieve the owner or driver of any vehicle from liability for any fine or penalty for a violation of the provision of this chapter for which the vehicle was removed or impounded or for a violation of any other provision of this Traffic Code or the Vehicle Code. 454.06    RECLAMATION COSTS.

In order to reclaim his or her vehicle, the owner shall pay towing and storage costs, plus a twenty-five dollar ($25. 00) fee, of which ten dollars ($10. 00) shall be transferred to the Pennsylvania Department of Transportation by the garage to which the vehicle was taken. 454.07    RECORDS OF VEHICLES REMOVED AND IMPOUNDED.

The Township shall cause a record to be kept of all vehicles impounded under this chapter and shall be able, at all reasonable times, to furnish an owner or an agent of an owner of such a vehicle with information as to the place of storage of the vehicle.

454.08    RESTRICTIONS UPON REMOVAL OF VEHICLES.

No vehicle shall be removed under the authority of this chapter or the Vehicle Code if, at the time of the intended removal, the owner or the person in charge of the vehicle is present and expresses a willingness and intention to remove the vehicle immediately. (Ord. 586. Passed 9-19-84.)

       

454.09    CONFLICTS OF LAW.

In the event of a conflict between any of the provisions of this chapter and any of the provisions of Chapter 450, the provisions of this chapter shall govern.

       

454.99    PENALTY.

Whoever violates or fails to comply with any of the provisions of this chapter shall be fined fifty dollars ($50.00), together with all costs of disposing of the vehicle under the Vehicle Code.
