816.01    DEFINITIONS.

As used in this chapter:

(a)   “Juke box” means a music vending machine, contrivance or device, which, upon the insertion of a coin, slug, token, plate, disc or key into a slot, crevice or other opening, or by the payment of a price, operates or may be operated for the emission of songs or music or for similar amusements.

(b)   “Mechanical or electronic amusement device” means a machine, contrivance or device, which, upon the insertion of a coin, slug, token, plate, disc or key into a slot, crevice or other opening, or by the payment of a price, may be operated or used as a game, entertainment or amusement, whether or not registering a score and whether or not a prize is offered. “Mechanical or electronic amusement device” includes, but is not limited to, a marble machine, pinball machine, skill ball machine, mechanical grab machine, mechanical bowling machine, photo­electric shooting or target machine, electronic video game, air hockey table, football game or any game, operation or transaction similar thereto. “Mechanical or electronic amusement device” does not include a device or machine which dis­penses merchandise, such as candy, cigarettes, etc.

(a)   “Operator” means a person who displays or maintains, for use and operation, a juice box or mechanical or electronic amusement device or pool table or who otherwise permits the use or operation of such device for a fee or charge.

(d)   “Person” means an individual, copartnership, association or corporation. Whenever used in any clause prescribing or imposing a penalty, “person, “as applied to a copartnership or an association, means the partners or members thereof and, as applied to a corporation, means the officers thereof.

(e)   “Pool table” means a table with cushions or pockets upon which games of pool or billiards in any form are played, upon payment of a price, whether or not operated by the insertion of a coin, slug, token, plate, disc or key into a slot, crevice or other opening. (Ord. 552. Passed 6-16-82.)


816.02    LICENSE REQUIRED.

No operator shall display, keep or maintain for use and operation, or otherwise permit the use and operation of, a pike box, mechanical or electronic amusement device, pool table or other similar machine or device without first having registered with and obtained a license from the Code Enforcement Officer as prescribed in this chapter.

816.03    LICENSE APPLICATIONS; ISSUANCE AND SEAL.

(a)   An operator who wishes to register and obtain a license as required by Section 816.02 shall apply to the Code Enforcement Officer. An application form may be secured from the office of the Code Enforcement Officer and shall set forth the following Information:

(1)   The name and business address of the operator;

(2)   A plan of the premises showing the location where the juke box, mechanical or electronic amusement device, pool table or other similar machine or device is to be displayed or maintained, as well as the location of the supervision of the establishment;

(3)   The type, manufacturer and serial number of each juke box, mechanical or electronic amusement device, pool table or other similar machine or device for which the application is being made; and

(4)   Such other information as the Code Enforcement Officer may deem necessary for the proper administration and enforcement of this chapter.

(b)   Upon approval of the application, the Code Enforcement Officer shall issue a license for each location where a juice box, mechanical or electronic amusement device, pool table or other similar machine or device is to be displayed or maintained, and may also issue a seal to be affixed to each pike box, mechanical or electronic device, pool table or other similar machine or device registered and licensed under this chapter. 816.04    FEES.

(a)   Registration and license fees shall be paid by the operator to the Code Enforcement Officer at the time the application provided for in Section 816.03 is filed. Such fees shall be as follows:

(1)   For each juice box, one hundred dollars ($100.00) per year or fraction thereof;

(2)   For each mechanical or electronic amusement device, two hundred dollars ($200.00) per year or fraction thereof;

(3)   For each pool table, one hundred dollars ($100. 00) per year or fraction thereof.

However, for 1982, the fees due and payable shall be one-half of the amounts set forth in this subsection.

(b)   No deductions or refunds of a fee shall be granted in case a fee is payable for less than a full calendar year or In case a device is destroyed, stolen, sold or otherwise disposed of or transferred after payment of the fee. If the registration of a device is transferred, there shall be a transfer fee of ten dollars ($10.00) for such device.

(c)   If an original license or seal is lost, defaced or destroyed, the person to whom such license or seal was Issued shall apply to the Code Enforcement Officer, who will then issue a new license or seal, upon payment of a fee of five dollars ($5. 00).
