820.06 DISTRIBUTION PERMIT REQUIRED.
No charitable organization shall distribute literature or any other article within the Township, whether or not solicitation for money or anything of monetary value is involved, without first applying for and obtaining a permit in accordance with Sections 820.03 to 820.05. Within five days after notice of the action to deny a solicitation or distribution has been mailed and hand delivered, the applicant shall notify the designated official, in writing, of his or her intent to contest such action. Within ten days after receipt of such notice to contest, a preliminary and permanent injunction to restrain the denied solicitation or distribution shall be issued in a court of competent jurisdiction, which action shall be governed by the applicable rules of procedure and the time limits thereunder. 820.08 ISSUANCE OF PERMITS AND IDENTIFICATION CARDS.
Upon the issuance of a permit required by this chapter, the Township Secretary shall note his or her approval in the Registry Book and shell, at that point, issue to the applicant, or to any agent or representative of the applicant who will participate under the permit, an identification card, which card shall state the applicant’s name, address, sex, height and color of hair and eyes and the full name of the charitable organization which he or she represents. 820.09 HOURS OF OPERATION; CONDUCT.
When a permit for a charitable solicitation or charitable literature distribution, or a combination thereof is granted, the following rules and standards shall apply:
(a) Time. Permit holders shall be restricted to the hours between 9:00 a.m. and dusk on the days of operation.
(b) Manner of Operation.
(1) Each person included in a permit shall wear the identification card issued by the Township on his or her upper clothing and in a manner clearly visible to the public. It shall not be transferred to another person and must be returned to the Township Secretary at the expiration of the permit.
(2) No person included in a permit shall initiate any physical contact with a prospective donor unless such donor has either consented to such contact or agreed to make a contribution.
(3) Permittees are, at all times, subject to all laws, statutes and ordinances, Federal, State or local, regarding fraud, assault, battery, theft, littering and other laws relating to the conduct of persons in public places. (Ord. 637. Passed 4-20-88.)
820.10 EFFECTIVE PERIOD OF PERMITS; RENEWALS.
A permit issued under this chapter shall expire thirty days from the date of issuance. A permit may be renewed for successive thirty-day intervals if written request for the same is received by the Township Secretary within ten days prior to the expiration date and if the request for renewal contains a statement that the request is predicated on the same information as contained in the original application. This chapter excludes from its operation and effect any charitable organization, the principal offices of which have been located within the Township for not less than one year. (Ord. 637. Passed 4-20-88.)
Whoever violates or fails to comply with any of the provisions of this chapter shall be fined not more than three hundred dollars ($300.00) or imprisoned not more than ninety days, or both.
