860.07    WAIVER OF FEE FOR CERTAIN FARMERS AND MANUFACTURERS.

Farmers vending exclusively the produce of their own farms and persons selling exclusively an article manufactured or made by themselves are required to appear in person before the Township Secretary or other officer assigned for such purpose and satisfy him under oath or affirmation that such is the case. If and when the Township Secretary or other officer is so satisfied, there shall be issued, without charge therefor, to such applicants, such license and/or identification card that would be issued to any other hawker or peddler under the provisions of this chapter, and, with the exception of the fee to be paid, the licenses shall be subject to all of the regulations herein contained or provided for.


860.08    WAIVER OF FEE FOR CERTAIN SERVICEMEN.

Every honorably discharged serviceman of the U. S. military service or Coast Guard of the United States, who is a resident of this State, and who is unable to procure a livelihood by manual labor, shall have the right to hawk, peddle or vend any goods, wares or merchandise or solicit trade within the Township by procuring a license or registration for that purpose to be issued without cost. However, before any such serviceman is entitled to the benefits of this chapter he shall satisfy the Township Secretary of his disability.


860.09    PARKING LIMITATIONS.

No licensee shall park a truck, automobile or other vehicle on any street or alley of the Township for the purpose of sorting, rearranging or cleaning his goods, wares or merchandise.  (Ord. 216. Passed 6-17-59.)


860.10   LIMITATIONS ON OCCUPATION OF CURBSTONES AND STREETS; HOURS OF VENDING.

Nothing in this chapter shall be construed to permit a licensee hereunder to keep or maintain a curbstone or street marked by parking vehicles along the highways or streets longer than is necessary to sell therefrom to the people residing in the immediate vicinity, and where no vehicle is used no licensee shall loiter, linger or remain on any street, curb or sidewalk.

No product shall be sold or dispensed directly from vehicles later than one-half hour after sundown.

No vending shall be permitted on Sunday until after 2:00 p.m., prevailing time. (Ord. 216. Passed 6-17-59.)


860.11    FRAUD; CANCELLATION OR NONISSUANCE OF LICENSES.

The Township Secretary, with the approval of the Board of Township Commissioners (or such member or members thereof as they may designate), may cancel without notice or refuse to issue any license when, in his judgment, the quality or price of the goods offered for sale, or the practice or methods employed, or the terms thereof, are such that fraud and deception may be practiced on, or injury or loss may be suffered by, residents. In the event of such cancellation or refusal of a license, the amount paid or the unused portion thereof shall be refunded by the Township Treasurer who is hereby authorized to do so.


         860.12   REVOCATION AND SEIZURE OF LICENSES AND PLATES.

Any license privilege granted under this chapter shall be revoked by the Township Secretary or other authorized officer for any unauthorized transfer or misuse of the license and/or for the violation of any statute, ordinance or regulation presently existing or that may in the future be enacted or put into force and effect. Any officer of the law is hereby authorized and directed to remove, by force or otherwise, any license plate, the user of which has been guilty of any offense set out or referred to in this section, and to forward such plate, together with a written report, to the Township Secretary or other authorized officer.


860.13   CHANGE OF ADDRESS.

It shall be the duty of each and every licensee, under this chapter, who has changed his place of residence, to appear in person at the office of the Township Secretary within a period of ten days from the date of such change of address or residence and to give notice of his new address.


860.14   FEE EXEMPTIONS.

A license and/or registration shall be required under this chapter when the proceeds of the sale or sales, after payment of reasonable expenses, inure:

(a)   Exclusively to the benefit of religious, educational and charitable institutions, societies or organizations, provided that no part of the net earnings of the institutions, societies or organizations inures to the benefit of any private shareholder or person;

(b)   Exclusively to the benefit of organizations or persons in the Armed Forces or the Coast Guard of the United States, or in National Guard organizations, reserve officers’ associations or organizations, posts or associations of war veterans, or auxiliary units or societies of such posts or organizations, or such posts, organizations, units or societies organized in the Commonwealth and if no part of their net earnings inures to the benefit of any private shareholder or person; or

(c)   Exclusively to the benefit of organizations or associations created and maintained for the purpose of benefiting employees of any political subdivision of the Commonwealth or their dependents or heirs or for the purpose of benefiting the members, or the dependents or heirs of members, of police or paid or volunteer fire departments of any political subdivision of the Commonwealth.  However, in all cases covered by subsections (a) through (c) hereof, no license fee shall be charged.
